The Motion by Plaintiff Deborah Bright (“Plaintiff”) for trial preference pursuant to Code of Civil Procedure (“CCP”) section 36(a) is GRANTED.

Plaintiff has met the statutory requirements of section 36(a): She is over 70 years old, has a substantial interest in the litigation, and the facts before the Court show her health is such that preference is necessary to prevent prejudicing her interest in the litigation. 

Trial will be set no more than 120 days after the date of entry of the order granting the Motion, pursuant to section 36(f).

All counsel shall be prepared at the hearing to set a specific trial date.

Plaintiff is ordered to give notice of this order.
