On July 14, 2022, Respondent filed a
Demurrer to Petitioner’s Third Amended Petition, arguing the following: (1)
Petitioner fails to allege facts sufficient to constitute a cause of action;
(2) The court lacks jurisdiction over the subject of the cause of action
alleged; and (3) Petitioner fails to demonstrate an exhaustion of
administrative remedies. On August 8, 2022 Petitioner untimely filed
an Opposition to the demurrer. The court
has not received a Reply.
Respondent should
address whether and when it received the Opposition, and how it wishes the
court to proceed in light of the above.
