The court will hear from the parties regarding its comments below and how best to move forward with the parties' motions.

According to the court's calendar, only one motion for summary judgment is set to be heard on January 12, 2024, and the motion was set via minute order on July 14, 2023. (ROA #242.) As the court recalls, the hearing was a resetting of Defendants' original motion for summary judgment, the grant of which the court had vacated. Yet, Plaintiff has apparently filed his own motion for summary judgment in connection with that same hearing date, instead of separately scheduling a motion and requesting that it be heard on the same date as Defendants' motion. The confusion this caused was compounded by Defendants' decision to rely on their original motion filings and not refile the motion or at least file an amended notice of the motion, and by the absence from the court's records of an opposition from Plaintiff to Defendants' motion (although it appears that some kind of opposition was at least served on Defendants).
