Plaintiff Douglas McCrady's motion for new trial is CONTINUED to May 31, 2024, at 9:00 a.m. in this department.
The court previously granted Plaintiff an extension of time to brief his motion for new trial, and granted Defendant Deanne Arthur's request to extend her time to file an opposition to 20 days following the filing of the motion. (ROA #181.) Plaintiff filed his motion and one supporting declaration on April 29, 2024, and a second supporting declaration on May 1, 2024. (ROA #'s 182-183, 185.) The court thus calculates Defendant's opposition deadline to be May 20, 2024, which is the Monday following the currently set hearing on Plaintiff's motion.
Consequently, the court continues the hearing to accommodate the adjusted briefing schedule. The continued hearing date still falls within the 75-day period for new trial motions. (Code Civ. Proc., § 660, subd. (c).) The due date for Plaintiff's reply is per code.
