Plaintiff William Kwangho Jung's motion to approve PAGA settlement is GRANTED.
Upon review of the materials submitted by Plaintiff, the court concludes the settlement is fair, reasonable, and adequate. (Moniz v. Adecco USA, Inc. (2021) 72 Cal.App.5th 56, 75-77.) The court therefore approves the settlement. (Lab. Code, § 2699, subd. (l)(2).) Plaintiff also requests $40,000.00 in attorney fees, $10,717.47 in costs, and for a $1,000.00 incentive award to Plaintiff. Based on experience with the southern California legal markets, including Los Angeles and San Diego, and the evidence submitted in the moving papers, the court concludes these requests are reasonable.
Plaintiff's request for payment of $3,995 to Phoenix Settlement Administrators, the Settlement Administrator, is reasonable and within the parameters defined by the settlement agreement.
Accordingly, this payment is approved.
Plaintiff's counsel's request for $40,000.00 in fees and $10,717.47 in costs is granted. Plaintiff's request for a $1,000.00 incentive award is also granted.
The court will sign the proposed order after the tentative ruling is confirmed.
