T/R: SINGER’S MOTION IS GRANTED. THE PARTIES ARE ORDERED TO TRANSFER THE UTILITY BILLS OUT OF SINGER’S NAME TO JONATHAN DECKEL WITHIN 15 DAYS OF NOTICE OF RULING.

The Court considers the moving papers. No opposition has been received.
CCP § 873.070 provides, “The referee or any party may, on noticed motion, petition the court for instructions concerning the referee’s duties under this title.”
Referee Singer moves for an order transferring the utility bills for the subject property from Singer to Jonathan Deckel. Singer asserts he is unable to do anything with the property as a result of the stay on appeal. There is a balance of over $4,000.00 owed for utilities and the continued failure to pay the bills is affecting Singer’s personal credit. Jonathan Deckel is living on the property and collecting rents on the property.
Singer’s motion is GRANTED. Jonathan Deckel shall transfer the utility bills to his name within 15 days of notice of ruling, including all amounts owing or past due. The Court authorizes the Clerk to release $1,291.01 from the funds deposited with the Court to reimburse Singer for bills he already has paid out-of-pocket.
