Motion to Enforce Settlement

PLAINTIFFS TO NOTICE.
The Court considers the moving papers, opposition, and reply.
“If parties to pending litigation stipulate, in a writing signed by the parties outside the presence of the court or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement.” (CCP § 664.6.)
Plaintiffs move to enforce the settlement agreement executed by the parties in March 2022. Plaintiffs assert that Defendants agreed to pay Plaintiffs $375,000.00, with an initial payment of $50,000.00 to be made 30 days after execution, followed by monthly $12,500.00 payments. Plaintiffs represent that Defendants have failed to make any payments and refuse to communicate with Plaintiffs.
In opposition, Defendant Arms Trans Inc. asserts that it did not agree to pay money under the settlement. Instead, only Defendants U Work Personnel, Inc. and Guillermo Rubio are obligated to pay Plaintiffs. Arms represents that it requested that Plaintiffs remove Arms from this motion and proposed order, but Plaintiffs refused. Arms requests sanctions against Plaintiffs.
As the settlement does not require Arms pay money, the motions is GRANTED as to Defendants U Work Personnel, Inc. and Guillermo Rubio only. The Court declines to award sanctions against Plaintiffs.
