The Court considers the moving papers. No opposition has been received.

“If parties to pending litigation stipulate, in a writing signed by the parties outside the presence of the court or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement.”  (CCP § 664.6.)

Defendant Yozura moves to enforce the settlement executed by Plaintiff and Defendant December 23, 2022 and enter judgment according to its terms. The settlement provides that Plaintiff will pay Defendant $37,000.00. The Court retained jurisdiction to enforce the settlement. Defendant represents that Plaintiff has not complied with agreement.

The motion is GRANTED. Defendant also is awarded attorneys’ fees and costs in the amount of $13,622.25 and $61.65, respectively.
