CROSS-DEFENDANT TO NOTICE.

The Court considers the moving papers and opposition.

            Cross-Defendant Office Ally, Inc. moves for summary adjudication of various causes of action in the operative cross-complaint. In opposition, Plaintiff asks the Court to continue the hearing to allow for completion of discovery. Plaintiff represents that OA’s counsel stated supplemental discovery responses would be served by January 13, 2023 and OA’s PMK deposition is only available for deposition after January 19, 2023. Plaintiff asserts that this discovery will produce evidence that disputes OA’s evidence. For example, discovery will show OA’s network service capabilities and functions and any contracts between OA and CCFM.

            Cross-Defendant’s motion for summary adjudication will be CONTINUED. The Court will address the schedule at the hearing.
