DEFENDANTS TO NOTICE.

The Court considers the moving papers. No opposition has been received.

Code of Civil Procedure § 685.090, subdivision (a), provides, in relevant part: “Costs are added to and become a part of the judgment: . . . (2) If a memorandum of costs is filed pursuant to Section 685.070 and no motion to tax is made, upon the expiration of the time for making the motion.” (Code Civ. Proc., § 685.090, subdivision (a)(1).) “After the time has passed for a motion to strike or tax costs or for determination of that motion, the clerk must immediately enter the costs on the judgment.” (Cal. Rules of Court, Rule 3.1700., subd. (b)(4), emphasis added.)

Defendants move to amend the January 28, 2025 judgment in their favor to enter $12,556.23 as the amount of costs. The January 28, 2025 proposed judgment contained a blank for costs. Defendants filed their memorandum of costs on December 17, 2024. Plaintiff has not challenged the costs via motion to tax costs. The motion is GRANTED.
