BACKGROUND

This is the lead case in a consolidated landlord-tenant action, comprised of 24 individual actions/plaintiffs.

ANALYSIS

CCP § 2024.020(a) provides, “Except as otherwise provided in this chapter, any party shall be entitled as a matter of right to complete discovery proceedings on or before the 30th day, and to have motions concerning discovery heard on or before the 15th day, before the date initially set for the trial of the action.”

Trial in this action is set for February 6, 2023. This motion is set to be heard on January 25, 2023, 12 days before trial. Discovery motions must be heard at least 15 days before trial. Defendant has not requested that discovery be reopened. Defendant’s motion is DENIED.
