“When actions involving a common question of law or fact are pending
before the court, it may order a joint hearing or trial of any or all the
matters in issue in the actions; it may order all the actions consolidated and
it may make such orders concerning proceedings therein as may tend to avoid
unnecessary costs or delay.” (CCP §
1048(a).)
Ying Chen, Plaintiff in a related case, moves to consolidate this case 20STCV48660
(J.E. Group, LLC, et al. v. CSM
Sycamore, LLC, et al.) and the related
case 23STCV11686 (Ying Chen
v. J.E. Group, LLC, et al.). In 23STCV11686, Chen alleges she is the
majority owner of J.E. Group, LLC and did not approve of J.E.’s initiation of 20STCV48660.
Chen asserts that the two cases have common questions of law and fact.
The Court declines to consolidate the actions. On August 2, 2023, the
parties in 20STCV48660 filed a stipulation for settlement of the entire case. 20STCV48660
is no longer active or “pending;” consolidation serves no purpose.
Chen’s motion to
consolidate is DENIED.
