Department 54, Judge Maurice A. Leiter
(2) Motions to Compel Further Responses to Discovery
Moving Party: Plaintiff Brian Ellis
Responding Party: Defendant General Motors LLC
T/R: PLAINTIFF’S MOTIONS ARE CONTINUED OCTOBER 28, 2022 AT 9:00AM.
THE PARTIES ARE ORDERED TO TELEPHONICALLY MEET AND CONFER AND FILE A JOINT DECLARATION STATING WHAT REMAINS AT ISSUE NO LATER THAN 7 DAYS BEFORE THE CONTINUED HEARING DATE.
PLAINTIFF TO NOTICE.
If the parties wish to submit on the tentative, please email the courtroom at SMCdept54@lacourt.org with notice to opposing counsel (or self-represented party) before 8:00 am on the day of the hearing.
The court considers the moving papers and opposition.
Plaintiff has filed two motions to compel further responses to discovery, one seeking further response to RPDs and the other SIs. Defendant opposed the motion to compel further responses to RPDs, stating it served supplemental responses. Defendant did not oppose the other motion. Plaintiff has not filed a reply to either motion.
It is unclear what the state of discovery is in this action. The parties are selectively responding to the motions and the Court cannot effectively rule on them. The Court will continue the motions. The parties are ordered to meet and confer and file a joint declaration stating what remains at issue no later than seven days before the continued hearing date. If nothing remains at issue, Plaintiff should withdraw the motions.
