The Court considers the moving papers. No opposition has been received.

 

“If parties to pending litigation stipulate, in a writing signed by the parties outside the presence of the court or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement.”  (CCP § 664.6.)

 

Plaintiff moves to enforce the settlement executed by Plaintiff and Defendants Advanced Building Systems, Inc. and Alex Youssef on October 3, 2022 and enter judgment according to its terms. The settlement provides that Defendant will pay Plaintiff the sum of $50,000, as follows: on or before November 1, 2022, a check in the amount $6,250; on or before December 1, 2022, a check in the amount $6,250; beginning on or before January 1, 2023, and for every month through February 1, 2025, a monthly check in the sum of $1,500. The Court retained jurisdiction to enforce the settlement.

 

Plaintiff represents that Defendants made nine payments and then defaulted, failing to pay the remaining $27,000 of the settlement. The settlement allows for the recovery of attorney’s fees to enforce the settlement. Plaintiff states that attorney’s fees in the amount of $5,160.00 and costs in the amount of $73.41 have been incurred to bring this motion. Defendants have not opposed this motion to show why it should not be granted.

 

The motion to enforce settlement is GRANTED.
