The Court considers the moving
papers. No opposition has been received.
Plaintiff moves for an order granting approval of
the proposed settlement of claims brought pursuant to the Private Attorneys
general Act of 2004 (“PAGA”), Cal. Lab Code § 2698, et seq. Pursuant to the
proposed settlement, Defendant Assignment America, LLC has agreed to pay $395,000. The settlement will be
distributed as follows: (1) $131,666.67 in attorney’s fees and up to $16,000 in
costs; (2) $4,650 for settlement administration costs, (3) $180,137.50 civil
penalty to be paid to LWDA (75% of remaining amount); (4) $60,045.83 to be paid
to the aggrieved employees (25% of remaining amount) and (5) $2,500.00 service
fee for the named Plaintiff.
Based on the moving papers, the Court finds that the
settlement is reasonable and meets the requirements of PAGA. Defendant has not
opposed. The motion is GRANTED.
