Section 473 of the Code of Civil Procedure provides that courts have the inherent power to correct inadvertent errors on judgments by a nunc pro tunc order. Plaintiff California Department of Health Care Services (“DHCS”) moves to amend the judgment, stating Plaintiff made an inadvertent clerical mistake by failing to include in its original application for renewal of judgment of all the Defendants named as judgment debtors in the original judgment issued on October 27, 2014. DHCS further states that the ten-year deadline to renew the initial judgment issued on October 27, 2014 has not yet expired. Plaintiff asks the Court to amend the Renewed Judgment that was renewed on November 7, 2023, to include Defendants Paris Davis and Trivian Davis as judgment debtors.

The Court so far has been unable to access the original complaint, judgment, abstracts of judgment or proof of service, and therefore cannot evaluate the motion. Plaintiff shall lodge courtesy copies of these documents by Monday August 26, 2024. The motion is continued to August 29, 2024 at 9:00 am.
