“If parties to pending litigation stipulate, in a writing signed by the parties outside the presence of the court or orally before the court, for settlement of the case, or part thereof, the court, upon motion, may enter judgment pursuant to the terms of the settlement.”  (CCP § 664.6.) 

            Plaintiff moves to enforce the settlement agreement executed by the parties on November 8, 2017, and to enter judgment. The parties agreed in writing before the Court that the settlement would be enforceable under CCP § 664.6. The agreement provides that Defendant Denise Lopez would pay $50.00 per month toward a $4,000.00 settlement amount. Plaintiff asserts that Lopez has since defaulted; Plaintiff seeks to enter judgement in the amount of $2,140.00 ($4,000 less Lopez’ past payments plus the filing fee for this motion). Plaintiff’s motion is GRANTED.
