Defendants Paul & Julian Metals, Inc. and Yun Sun Mo’s Motion to Quash Subpoena or, in the alternative, for Protective Order
Defendants Paul & Julian Metals, Inc. and Yun Sun Mo move to quash a subpoena to Commonwealth Business Bank served by plaintiff Core Commodity International, Inc. or, in the alternative, for a protective order. For the following reasons, defendants’ motion is denied.
The deposition subpoena for production of business records directs Commonwealth Business Bank to produce 30 categories of documents. Hwang Decl. Ex. 1. “Any motion involving the content of a discovery request or the responses to such a request must be accompanied by a separate statement.” Cal. R. Ct. 3.1345(a). “The motions that require a separate statement include a motion . . . (5) To compel or to quash the production of documents or tangible things at a deposition.” Cal. R. Ct. 3.1345(a)(5).
Defendants did not file a separate statement in support of their motion. In addition to failing to comply with Rule 3.1345(a), defendants’ failure to file a separate statement renders the court unable to determine defendants’ specific objections to specific categories of documents. See Cal. R. Ct. 3.1345(c) (“A separate statement is a separate document filed and served with the discovery motion that provides all the information necessary to understand each discovery request and all the responses to it that are at issue.”). Defendants’ motion is denied.
