Defendant Aerotek, Inc.’s Motion to Compel Arbitration

Defendant Aerotek, Inc. moves to compel arbitration of plaintiff Hugo Divers’s causes of action against Aerotek and defendants Sunpower Corporation, Norman Blaise, and Fernando Calderon.  Plaintiff filed a Notice of Non-opposition to Aerotek’s motion.  No other party has filed an opposition to the motion.  The motion to compel arbitration of plaintiff’s causes of action against Aerotek and Sunpower is granted. 

Plaintiff has not served either defendant Blaise or defendant Calderon and thus neither has appeared in the action.  Aerotek’s motion to compel arbitration of plaintiff’s causes of action against Blaise and Calderon is denied without prejudice.

This case is stayed pending completion of the arbitration.  An ADR Review hearing is scheduled for February 9, 2023 at 9:00 a.m. in Department C13.

Aerotek’s request for judicial notice was not material to the disposition of the motion.
