Judge: Melissa R. Mccormick, Case: Flores v. Anguiano, Date: 2022-07-28 Tentative Ruling
Attorney Michael K. Wolder’s Motion to be Relieved as Counsel
Attorney Michael K. Wolder moves to be relieved as counsel for defendant Robert Anguiano dba Robert Anguiano Construction. The motion is denied. The motion does not comply with California Rule of Court 3.1362, which governs motions to be relieved as counsel.
Rule 3.1362(c) requires a motion to be relieved as counsel to be accompanied by a declaration on the Declaration in Support of Attorney's Motion to Be Relieved as Counsel-Civil form (form MC-052). The Wolder Declaration filed with the motion does not utilize form MC-052 and omits some of the information required to be included. See, e.g., form MC-052 (Item 3(b)).
This denial is without prejudice to counsel refiling a motion that complies with Rule 3.1362 in all respects.
Attorney Michael K. Wolder to give notice.
