Defendant Western University of Health Sciences’ Motion to Transfer Venue

Defendant Western University of Health Sciences moves to transfer venue of this case from Orange County Superior Court to Los Angeles County Superior Court.  No oppositions to defendant’s motion have been filed.  Plaintiff Catherine Elizabeth Graham states in her complaint that she “agrees to have the proceedings transferred to Los Angeles County, or the county of Defendants’ [sic] residence.”  Complaint ¶ 5.  Based on plaintiff’s failure to oppose defendant’s motion and plaintiff’s stated agreement to transfer venue to Los Angeles County Superior Court, defendant’s motion is granted.  This case is ordered transferred to Los Angeles County Superior Court.  Civ. Proc. Code § 395.5.

Defendant’s request that this court order the case transferred to the Pomona Courthouse in Los Angeles County Superior Court is denied without prejudice to defendant addressing a specific courthouse assignment with the Los Angeles County Superior Court upon transfer.

Case Management Conference

In a concurrently-issued order, the court granted defendant Western University of Health Sciences’ motion to transfer venue to Los Angeles County Superior Court.  The Case Management Conference is vacated.
