Attorney Daniel Azizi’s Motion to be Relieved as Counsel
Attorney Daniel Azizi moves to be relieved as counsel for plaintiff Raymond Guzman. The motion is denied.
Counsel’s declaration states counsel, inter alia, mailed the motion papers to plaintiff’s last known address, return receipt requested, but the court file does not contain a proof of service reflecting such service. Indeed, the court file does not contain any proof of service of the motion papers. See Cal. R. Ct. 3.1362(d) (“The notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case.”). This denial is without prejudice to counsel refiling a motion that complies with Rule 3.1362 in all respects.
The moving party, Attorney Daniel Azizi, shall give notice of the court’s order.
