Plaintiff Immigrant Rights Defense Council, LLC’s Motion to Compel Responses to Form Interrogatories

Plaintiff Immigrant Rights Defense Council, LLC moves to compel defendant Allen Shoraka to provide responses to plaintiff’s Form Interrogatories (Set One).  Defendant has not served responses to the Form Interrogatories (Set One).  For the following reasons, plaintiff’s motion is granted.

Due to defendant’s failure to serve timely responses to the interrogatories, defendant has “waive[d] any right to exercise the option to produce writings under Section 2030.230, as well as any objection to the interrogatories, including one based on privilege or on the protection for work product . . . .”  Cal. Civ. Proc. Code § 2030.290(a).  Defendant Allen Shoraka shall provide responses, without objections, to plaintiff’s Form Interrogatories (Set One) by September 19, 2022.

Plaintiff’s request for sanctions is granted.  Defendant Allen Shoraka shall pay sanctions in the amount of $460.00 to plaintiff by September 19, 2022.  See, e.g., Cal. Civ. Proc. Code § 2023.010(d); id. § 2030.290(c).

Defendant’s request for judicial notice is denied because the materials are not relevant to the disposition of this motion.

The trial is scheduled for January 22, 2024 at 9:00 a.m. in Department C13.

Defendant OC Attorney Service, Inc. is a corporation and cannot represent themselves.  Gamet v. Blanchard (2001) 91 Cal.App.4th 1276, 1284 n.5.  This defendant must obtain representation or risk forfeiting important rights through nonrepresentation.  Id.  Defendant OC Attorney Service, Inc. is ordered to obtain counsel and file evidence thereof with the court by October 7, 2022.
