Plaintiff Immigrant Rights Defense Council, LLC’s Motion to Compel Responses to Form Interrogatories

Plaintiff Immigrant Rights Defense Council, LLC moves to compel defendant OC Attorney Service, Inc. to provide responses to plaintiff’s Form Interrogatories (Set One).  Defendant’s counsel states in a declaration filed September 27, 2022 (ROA No. 63) that defendant served responses to the interrogatories on September 18, 2022.  Defendant’s responses served on September 18, 2022 are untimely.  For the following reasons, plaintiff’s motion is granted.

Due to defendant’s failure to serve timely responses to the interrogatories, defendant has “waive[d] any right to exercise the option to produce writings under Section 2030.230, as well as any objection to the interrogatories, including one based on privilege or on the protection for work product . . . .”  Cal. Civ. Proc. Code § 2030.290(a).  Defendant OC Attorney Service, Inc. shall provide responses, without objections, to plaintiff’s Form Interrogatories (Set One) by October 10, 2022.

Plaintiff’s request for sanctions is granted.  Defendant OC Attorney Service, Inc. shall pay sanctions in the amount of $460.00 to plaintiff by October 10, 2022.  See, e.g., Cal. Civ. Proc. Code § 2023.010(d); id. § 2030.290(c).

Defendant’s request for judicial notice is denied because the materials are not relevant to the disposition of this motion.
