Plaintiff Immigrant Rights Defense Council, LLC’s Motion to Compel Responses to Requests for Production
Plaintiff Immigrant Rights Defense Council, LLC moves to compel defendant OC Attorney Service, Inc. to provide responses to plaintiff’s Requests for Production (Set One). Defendant’s counsel states in a declaration filed September 27, 2022 (ROA No. 63) that defendant served responses to the requests on September 18, 2022. Defendant’s responses served September 18, 2022 are untimely. For the following reasons, plaintiff’s motion is granted.
Due to defendant’s failure to serve timely responses to the requests, defendant has “waive[d] any objection to the demand, including one based on privilege or on the protection for work product . . . .” Cal. Civ. Proc. Code § 2031.300(a). Defendant OC Attorney Service, Inc. shall produce documents and provide responses, without objections, to plaintiff’s Requests for Production (Set One) by October 24, 2022.
Plaintiff’s request for sanctions is granted. Defendant OC Attorney Service, Inc. shall pay sanctions in the amount of $460.00 to plaintiff by October 24, 2022. See, e.g., Cal. Civ. Proc. Code § 2023.010(d); id. § 2031.300(c).
Defendant’s request for judicial notice is denied because the materials are not relevant to the disposition of this motion.
