Judge: Melissa R. Mccormick, Case: Kirk v. Westminster Elementary School District, Date: 2022-09-08 Tentative Ruling

Defendant Westminster School District’s Motion to Compel Further Responses to Requests for Production

Defendant Westminster School District moves to compel plaintiff Robin Kirk to provide further responses to Requests for Production (Set One) Nos. 1 through 180.  Defendant’s motion is granted in part and denied in part.

The court has reviewed plaintiff’s responses and supplemental responses to the Requests for Production (Set One), as well as defendant’s 486-page separate statement.  Plaintiff’s supplemental responses to Request Nos. 16, 17, 18, 28, 29, 35, 36, 37, 42, 124, 177, and 179 are deficient.  Plaintiff is ordered to serve complete, verified further responses to Request Nos. 16, 17, 18, 28, 29, 35, 36, 37, 42, 124, 177, and 179 by September 19, 2022, and to produce all nonprivileged documents responsive to those requests by the same date.

Defendant’s motion to compel is denied in all other respects.  Plaintiff, a self-represented litigant, provided sufficient supplemental responses to the other requests in defendant’s voluminous set of requests for production.

Defendant’s request for sanctions is denied.

Defendant to give notice.
