RULING: The unopposed motion is granted. 

On 3/29/22, Plaintiff Wells Fargo Bank, NA (Plaintiff) served Requests for Admissions, Set 1, on Defendant David Benhamo (Defendant) by mail.  (Brar Decl. ¶4, Ex.A).  As such, responses were due on or before 5/3/22.  CCP 2033.250(a); CCP 1013.  As of the filing of the motion, no responses have been served.  (Brar Decl. ¶5).

On 6/15/22, Plaintiff filed and served the instant motion seeking an order that the genuineness of documents and the truth of matters asserted in Plaintiff’s Requests for Admissions, Set 1, to Defendant be deemed admitted.  No opposition/response to the motion has been filed. 

Due to Defendant’s failure to serve responses to the subject requests for admissions, Plaintiff is entitled to an order deeming the genuineness of documents and the truth of matters asserted in Plaintiff’s Requests for Admissions, Set 1, admitted.  CCP 2033.280(b)-(c).
