RULING: The unopposed motion is granted. 

***Plaintiff has filed a Notice of Submission indicating that Plaintiff’s counsel intends to submit on the moving papers without appearing if there is no opposition filed.

On 12/23/21, Plaintiff Bank of America, N.A. (Plaintiff) served Defendant Aram Mouradian (Defendant) with Requests for Admission, Set 1.  (Karayan Decl. ¶3, Ex.1).  Defendant failed to serve any responses and failed to respond to Plaintiff’s meet and confer letter.  (Id. ¶¶4-5, Ex.2)

On 10/21/22, Plaintiff Bank of America, N.A. filed (served 10/14/22) the instant motion seeking an order deeming the truth of each matter specified in the requests for admissions served on Defendant on 12/23/21 admitted.  Defendant has not opposed or otherwise responded to the motion.

Due to Defendant’s failure to respond to the subject Requests for Admissions, Plaintiff is entitled to an order deeming the matters therein admitted.  See CCP 2033.280(a)-(c).
