DEMURRER TO THE ORIGINAL COMPLAINT

MOVING PARTY: Defendant Thibant International Inc.

RULING: The hearing will be continued.

The demurrer was never filed with the Court.  On 4/20/22, the demurrer was rejected because the case had been transferred to Department F47 and the hearing date was vacated.  On 5/16/22, Defendant Thibant International Inc. (Defendant) filed an Amended Notice of Demurrer to Complaint setting forth the 8/11/22 hearing date in Department F47.  However, the demurrer was not attached to the amended notice.  As such, the Court does not have access to the demurrer to review it on the merits along with the opposition and reply which have been filed and appear in eCourt.

Therefore, the hearing on the demurrer will be continued to an available date on the Court’s calendar.  Defendant is ordered to file the demurrer by 4:00 p.m. on 8/11/22.
