RELIEF REQUESTED: An order admitting Susan Kaczmarcyzk to appear as counsel in this action pro hac vice for Defendant Coexist Ventures LLC.

RULING:

The application and supporting papers were served one day short of the required 16 court days plus 2 court days notice required for electronic service.  See CCP 1005(b); CCP 1010.6(a)(3)(B).  While the application/motion indicate that they were served on the State Bar of California at its San Francisco office, the proof of service for same does not show service on the State Bar of California as required.  See CRC 9.40(c)(1).

The declaration of Susan Kaczmarcyzk does not set forth her home address as required.  See (Kaczmarcyzk Decl. ¶1); CRC 9.40(d)(1).

If Plaintiff waives the timeliness defect, a proof of service showing service on the State Bar of California is filed and the residence address of Susan Kaczmarcyzk is provided, the application will be granted.  If not, the hearing on the petition will be continued to allow the foregoing defects to be cured.
