RELIEF REQUESTED: An order compelling Plaintiff Levon Misirli to provide responses to Defendant Jess Anthony Ybarra’s Form Interrogatories, Set 1.  Additionally, Defendant requests sanctions against Plaintiffs and their counsel in the amount of $455.34.

RULING: At the time of work-up on 1/29/25, no opposition had been filed.  Check to see if opp filed before 2/3 hearing date.

The unopposed motion is granted as set forth below.  Responses are due and sanctions are payable within 20 days. 

On 3/21/24, Defendant Jess Anthony Ybarra served the subject Form Interrogatories, Set 1, on Plaintiff Levon Misirli.  The plaintiff was granted an extension until 5/17/24 to respond.  No responses were served. 

Due to Plaintiff’s failure to provide timely responses to the discovery, Defendant is entitled to an order compelling responses without objection.  CCP 2030.290(a), (b).  Additionally, Defendant is entitled to an award of sanctions against Plaintiff and his counsel for his failure to comply with his discovery obligations.  CCP 2030.290(c); CCP 2023.010(d); CCP 2023.030(a).  Therefore, sanctions are imposed against Plaintiff and his counsel in the amount of $455.00.
