Demurrer is to the 4th, 5th and 6th causes of action:

1.      Reproductive Health Decision-Making Discrimination in Violation of FEHA (Gov’t Code 12940, et seq.)

2.      Sex Discrimination in Violation of FEHA (Government Code 12940, et seq.)

3.      Disability Discrimination in Violation of FEHA (Government Code 12940, et seq.)

4.      Retaliation in Violation of FEHA (Government Code 12940, et seq.)

5.      Harassment in Violation of FEHA (Government Code 12940, et seq.)

6.      Failure to Prevent Discrimination, Harassment and/or Retaliation in Violation of FEHA (Government Code 12940(k))

7.      Failure to Engage in the Interactive Process in Violation of FEHA (Government Code 12940, et seq.)

8.      Failure to Accommodate in Violation of FEHA (Government Code 12940, et seq.)

9.      Retaliation in Violation of Labor Code 1102.5

10.  Wrongful Termination in Violation of Public Policy

 

RELIEF REQUESTED IN MOTION TO STRIKE: An order striking certain portions of the complaint.

 

RULING: The demurrer and motion to strike are placed off calendar. 

 

On 6/27/23, Plaintiff Sanah “Sonya” Hamad (Plaintiff) filed this action against Defendants Prezzee, Inc. and Peter Durham (Defendants) for: (1) Reproductive Health Decision-Making Discrimination in Violation of FEHA (Gov’t Code 12940, et seq.); (2) Sex Discrimination in Violation of FEHA (Government Code 12940, et seq.); (3) Disability Discrimination in Violation of FEHA (Government Code 12940, et seq.); (4) Retaliation in Violation of FEHA (Government Code 12940, et seq.); (5) Harassment in Violation of FEHA (Government Code 12940, et seq.); (6) Failure to Prevent Discrimination, Harassment and/or Retaliation in Violation of FEHA (Government Code 12940(k)); (7) Failure to Engage in the Interactive Process in Violation of FEHA (Government Code 12940, et seq.); (8) Failure to Accommodate in Violation of FEHA (Government Code 12940, et seq.); (9) Retaliation in Violation of Labor Code 1102.5 and (10) Wrongful Termination in Violation of Public Policy.

 

On 2/1/24, Defendants filed and served the instant demurer to the 4th, 5th and 6th causes of action and motion to strike certain portions of the complaint which are set for hearing on 2/1/24.  On 1/19/24, nine court days before the hearing, Plaintiff filed and served a First Amended Complaint which renders the demurrer and motion to strike moot.  See CCP 472(a); CCP 1005(b).
