RELIEF REQUESTED: An order relieving Lawrence Szabo as counsel for Plaintiff Terry Mack in this action. 

 

RULING: The motion is granted. 

 

On 12/31/24, attorney Lawrence Szabo filed and served the instant motion to be relieved as counsel for Plaintiff Terry Mack in this action.  The motion papers indicate 5/8/25 as the hearing date.  On 12/31/24, the court rescheduled the hearing date to 3/10/25.  On 1/6/25, a separate proof of service for the motion papers was filed indicating service of same on 1/4/25 by mail, on Plaintiff, along with a Notice of Change of Hearing Date.  The original proofs of service attached to the motion papers indicate electronic service on Plaintiff and on defense counsel on 12/31/24. 

 

On 2/6/25, the Court continued the hearing on the motion from 3/10/25 to 3/19/25.  (See 2/6/25 Notice Re: Continuance of Hearing and Order).  On 3/4/25, attorney Szabo filed and served a Notice of Continuance of the Hearing from 3/10/25 to 3/19/25.  (See 3/4/25 Notice of Continuance). 

 

Attorney Szabo seeks to withdraw on the ground there has been a breakdown in the attorney-client relationship which makes it unreasonably difficult for him to continue to represent Plaintiff.  Attorney Szabo indicates that the client’s address has been confirmed by mail, return receipt requested and by conversation.  No opposition or other response to the motion has been filed.
