SUMMARY OF ACTION: This action arises out of a motor vehicle collision with the minor being a passenger in one of the involved vehicles.  As a result of the collision, the minor sustained soft tissue injuries to minor’s shoulder and neck.  Minor received emergency room treatment followed by chiropractic treatment.  The minor has completely recovered from the injuries. 

 

SETTLEMENT: Defendants to pay $14,000.00

 

ATTORNEY FEES: $3,000.00

 

MEDICAL BILLS: $3,365.00 (total); $120.00 (paid); $370.00 (reduction); $2,955.00 (to be paid from settlement)

 

COSTS: $45.00

 

AMOUNT TO BE PAID TO MINOR: $8,000.00 to be placed in a blocked account.

 

RULING: The hearing will be continued.

 

The petition and/or proposed order include the following defects:

 

(1) In No.11.(b).(2) and (3) both boxes are marked when it should be one or the other. 

 

(2) It appears that No.11.b.(4) should be marked, but it is not. 

 

(3) The wrong box is marked in No.17.f.  As seen by the accompanying petition for minor Benjamin Pham, the attorney expects to receive $3,000.00 in fees from that settlement.  It also seems likely that the attorney expects to receive fees from the settlements of Manh Pham’s and Lan Pham’s claims.  (See Petition, No.11.b.(5)). 

 

(4) No.8.a.(4) in the proposed order approving compromise should be $45.00, not $40.00.

 

(5) No.9.a. in the proposed order approving compromise is not completed.
