RELIEF REQUESTED: An order compelling Plaintiff Vincente Contreras to arbitrate this matter and to stay the proceedings pending completion of arbitration. 

 

RULING: The motion is granted.

 

On 11/2/23, Plaintiff Vicente Contreras (Plaintiff) filed this action against Defendants Ford Motor Company and Valencia H Imports, Inc. dba AutoNation Honda (collectively, Defendants) related to the purchase of a used 2021 Ford F-150 vehicle on 8/21/22.  On 12/1/23, Defendants filed an answer to the complaint. 

 

On 7/12/24, Defendants filed and served the instant motion seeking an order compelling Plaintiff to arbitrate this matter and to stay the proceedings pending completion of arbitration.  On 12/13/24, Plaintiff filed and served a Notice of Non-Opposition to the motion indicating that Plaintiff conditionally does not oppose the motion and stipulates to stay the matter to allow an arbitrator to determine the arbitrability of all claims.  Plaintiff further indicates that he reserves the right to make any argument as to the arbitrability of the claims at such time. 

 

The motion is granted.  The action is stayed pending the completion of the arbitration.      

 

The Court notes that Defendants have failed to electronically bookmark the exhibits attached to the Request for Judicial Notice and Fakhouri declaration filed in support of the motion in violation of CRC 3.1110(f)(4).  Counsel for the parties are warned that failure to comply with this rule in the future may result in matters being continued so that papers can be re-filed in compliance with the rule, papers not being considered and/or the imposition of sanctions.
