On 2/27/24, Defendant Linda Draves (Defendant) filed and served the instant demurrer to the 3^rd cause of action for Negligent Infliction of Emotional Distress in Plaintiff Julie Kim’s (Plaintiff) complaint.

On 2/28/24, Plaintiff dismissed the 3^rd cause of action with prejudice.  (See 2/28/24 Request for Dismissal).  On 3/11/24, Defendant answered the complaint.  (See 3/11/24 Answer). 

Based on the foregoing, the demurrer is moot.
