Case #PC036281

MOTION TO AMEND JUDGMENT

MOVING PARTY: Plaintiff/Creditor Fidelity National Title Group, as assignee of Transnation Title Insurance Company

RESPONDING PARTY: Defendants/Judgment Debtors William Vargas dba J.V.M. Insurance Agent; Juan C. Vargas and Miriam Murillo

RULING: The hearing is placed off calendar.

On 1/13/23 Fidelity National Title Group, as assignee of Transnation Title Insurance Company was denied without prejudice.  (See 1/13/23 Minute Order).  On that same date, the Court scheduled a new hearing for a Motion to Amend Judgment on 4/12/23.  (Id. at p.3).  Additionally, Plaintiff was ordered to give notice.  (Id. at p.4).

Since the 1/13/23 hearing date, Fidelity has only filed an Acknowledgment of Assignment of Judgment which does not reference any hearing date and does not include a proof of service.  (See Acknowledgment of Assignment of Judgment filed 2/28/23).  A new motion has not been filed which is required to address all of the issues raised in the Court’s 1/13/23 ruling.  (See 1/13/23 Minute Order).

Therefore, the hearing is placed off calendar.
