The Motion to Have the Court Waive the Rawlings Company's Claim of Lien brought by plaintiff Leilani Mason, by and through her guardian ad litem, Cecilia Dominguez (together, Plaintiff) is GRANTED. The matter has been properly noticed, with proof of service on file. The motion is unopposed. Failure to oppose constitutes a waiver and/or admission that a motion is meritorious.
Additionally, the Court is mindful that the purpose of the underlying motion is to resolve an issue that arose with regard to a Petition for Approval of Minor's Compromise. The motion being granted, Plaintiff is directed to resubmit an up-to-date Petition that will be reviewed, modified (if necessary), and executed.
Beyond that, the Court notes that the minor in question has now reached the age of majority. However, as it appears that the original settlement between the parties made approval of a Petition for Approval of Minor's Compromise a requirement of the settlement, the Court grants the motion for purposes of that contractual need even though approval of a minor's compromise may no longer be necessary given that the minor is now an adult.
Unless the ruling(s) above indicate that an appearance is necessary, parties who wish to submit, who are satisfied with the above tentative ruling(s), and/or who do not otherwise wish to argue the motion(s) are encouraged to give notice to the Court and each other of their intention not to appear.
