The Motion (1) To Compel Written Discovery Without Objections; (2) for Requests for Admission to Be Deemed Admitted brought by defendant City of Escondido (the City) is GRANTED. The Request for Monetary Sanctions brought by the City is GRANTED in the amount of $500.00.

The matter has been properly noticed, with proof of service on file. The motion is unopposed. Failure to oppose constitutes a waiver and/or admission that a matter is meritorious. Defendant has established, with evidence, that it propounded discovery, that the statutory time frame (and any agreed upon extensions) for responding to that discovery has lapsed, and that plaintiff Pedro Alamo, Jr. (Plaintiff) has not responded within the legal and/or agreed upon time frame.

Pursuant to Code of Civil Procedure §§ 2030.290 and 2031.300, plaintiff Pedro Alamo, Jr. is ORDERED to serve verified responses on the City, without objection, to the City's Form Interrogatories, Special Interrogatories, and Requests for Production of Documents within 14 days of service of a copy of this order on Plaintiff. Said responses are to be mailed to the attention of Attorneys Michael McGuinness, Keith Phillips, and Mark Bookholder of the Office of the City Attorney at 201 N. Broadway, Escondido, California 92025.

Pursuant to Code of Civil Procedure § 2033.280, the City's Requests for Admission are DEEMED ADMITTED.

Pursuant to Code of Civil Procedure §§ 2030.290, 2031.300, and 2033.280, plaintiff Pedro Alamo, Jr. is ORDERED to pay monetary sanctions in the amount of $500.00. Said sanctions shall be sent to Attorneys Michael McGuinness, Keith Phillips, and Mark Bookholder of the Office of the City Attorney at 201 N. Broadway, Escondido, California 92025.

Unless the ruling(s) above indicate that an appearance is necessary, parties who wish to submit, who are satisfied with the above tentative ruling(s), and/or who do not otherwise wish to argue the motion(s) are encouraged to give notice to the Court and each other of their intention not to appear.
