Attorney Paul Miailovich (Miailovich) moves to be admitted pro hac vice as counsel for Defendant Lorenzo Quiroz, Jr. (Defendant).
Per California Rules of Court, rule 9.40, attorneys who are licensed to practice and in good standing in other states may, upon court approval, appear as counsel pro hac vice in a pending case if an active member of the State Bar of California also appears as counsel of record. (Cal. Rules of Court, rule 9.40, subd. (a).)
Miailovich is licensed to practice and in good standing in Idaho. Miailovich is a resident of Puerto Vallarta, Jalisco Mexico on a Temporary Residence Visa, and has not appeared pro hac vice in California within the last two years. Miailovich is associated with Defendant’s counsel, Andrew Post, who is licensed to practice in California.
However, the proof of service Miailovich attached to his application supposedly establishing service on the State Bar of California is unsigned. (See Application of Paul Miailovich, Exhibit A.) Service of the application on the State Bar of California at its San Francisco office is required. (Cal. Rules of Court, rule 9.40, subds. (c).)
Accordingly, the Court denies the application to appear pro hac vice without prejudice as procedurally defective.
Defendant shall provide notice of this order and file proof of service of such.
