MOTION 

 

 Babak Bobby Yaghoubian of Power Legal Group, PC (Counsel) moves to be relieved as counsel for Plaintiff Terrell Dion Hawkins (Plaintiff).

 

ANALYSIS 

 

Counsel has not filed proofs of service in connection with the motion to indicate that Counsel served the notice of the motion, motion, declaration in support of the motion, and proposed order on Plaintiff.  (See Cal. Rules of Court, rule 3.1362, subd. (d) [“[t]he notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case”].)  The Court notes that the proof of service attached to the moving papers indicate that Counsel served such papers electronically on counsel for Defendant Jennifer Sokulski only.

 

Accordingly, the Court denies Counsel’s motion to be relieved as counsel as procedurally defective.
