TENTATIVE RULING

MOTION

            Oliver Lasley of BD&J, P.C. (Counsel) moves to be relieved as counsel for Plaintiff Arturo Robles Bermudez (Plaintiff).  

ANALYSIS

Counsel has not filed proofs of service in connection with the motion to indicate that Counsel served the notice of the motion, motion, declaration in support of the motion, and proposed order on Plaintiff and the remaining parties. (See Cal. Rules of Court, rule 3.1362, subd. (d) [“[t]he notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case”].)  Here, the proof of service filed on January 6, 2023, does not indicate that Defendant Los Angeles County Metropolitan Transportation Authority has been served with the moving papers. 

Accordingly, the Court denies without prejudice Counsel’s motion to be relieved as counsel as procedurally defective.
