TENTATIVE RULING

            Defendant County of Los Angeles (Defendant) moves to dismiss the Second Amended Complaint of Plaintiff Bernadean Ross (Plaintiff).  Plaintiff has not filed an opposition to the motion.

            Preliminarily, the Court notes Plaintiff has not filed a Second Amended Complaint.  As such the Court finds Defendant’s motion to dismiss the non-existent Second Amended Complaint to be non-justiciable.
