MOTION
Michael R. Parker (Counsel) moves to
be relieved as counsel for Plaintiff Gregory Armstead (Plaintiff).
ANALYSIS
Counsel has not filed a proof of service in connection with the motion
to indicate that Counsel served the notice of the motion, motion, declaration
in support of the motion, and proposed order on all the parties which have
appeared in the action. (See Cal. Rules of Court, rule 3.1362, subd. (d)
[“[t]he notice of motion and motion, the declaration, and the proposed order
must be served on the client and on all other parties who have appeared in the
case”].) Here, the proof of service
filed on February 8, 2023, does not indicate that Defendant 2023 Corning Iola
LLC has been served with the moving papers.
Accordingly, the Court denies without prejudice Counsel’s motion to be
relieved as counsel as procedurally defective.
