TENTATIVE RULING

MOTION

This case arises from an alleged motor vehicle accident.  Defendant Adolfo Barrera (“Defendant”) has moved to strike from the Complaint the prayer for punitive damages. 

Plaintiffs Jesse Pastor-Lawrence and Axel Navarro-Lawrence (collectively, “Plaintiffs”) have filed a notice of non-opposition, indicating Plaintiffs agree to strike from the Complaint the prayer for punitive damages.

CONCLUSION AND ORDER

Therefore, the Court grants Defendant’s unopposed Motion to Strike the prayer for  punitive damages from the Complaint.

Further, the Court orders Defendant to file and serve an Answer to the complaint on or before February 28, 2024.

Defendant shall provide notice of the Court’s ruling and file a proof of service regarding the same.
