Motion to Compel Production

 

Plaintiff, Matthew Delaney’s Motion to Compel Further Responses to Requests for Production, Set One is CONTINUED to 11-06-2023 at 1:45 p.m. in Department C15.

 

The parties have not engaged in sufficient attempts to meet and confer regarding this motion. Code of Civil Procedure § 2016.040; see Clement v. Alegre (2009) 177 Cal.App.4th 1277, 1293 [Discovery Act requires moving party to declare he or she has made a serious attempt to obtain an informal resolution of each issue; rule designed to encourage parties to work out their differences informally to avoid necessity for formal order, which lessens burden on court and reduces unnecessary expenditure of resources for litigant].

The parties are ORDERED to engage in additional attempts to meet and confer, including a telephonic, videoconference or in-person conference no later than 08/30/2023. If Defendant agrees to provide further responses, Defendant shall provide and serve verified further responses no later than 09/29/2023.

No later than 16 court days before the hearing, the parties shall file and serve a supplemental joint statement, not to exceed five pages, which shall describe the parties’ attempts to meet and confer pursuant to this order and identify each request that remains in dispute. Any further responses served by Defendant shall be attached to joint statement.

Plaintiff is to give notice.
