Defendant Crystal Property Management, Inc.’s Motion for Summary Adjudication is DENIED as moot.

 

BACKGROUND:

On October 5, 2020, Plaintiff Mei Ling Harper filed her Complaint against Chloe’s Apartments, LLC, Apartment Management Group, LLC, Adrian Malin, and Dan Zuckerman on various causes of action related to habitability issues with Plaintiff’s apartment.

On August 9, 2021, Plaintiff filed her First Amended Complaint, which, among other things, added Crystal Property Management, Inc. as a Defendant.

On November 30, 2021, Plaintiff filed her Second Amended Complaint. Crystal Property Management, Inc. remained a Defendant in the Second Amended Complaint.

On April 20, 2022, Plaintiff filed her Third Amended Complaint. Crystal Property Management, Inc. remained a Defendant in the Second Amended Complaint.

On August 10, 2022, Defendant Crystal Property Management, Inc. filed its Motion for Summary Adjudication.

On October 25, 2022, by request of Plaintiff, the Clerk’s Office entered dismissal without prejudice on Defendant Crystal Property Management, Inc. from the Third Amended Complaint.

ANALYSIS:

 

Defendant Crystal Property Management, Inc. moves the Court to award summary adjudication on the sixth cause of action (nuisance) in Plaintiff’s Third Amended Complaint. However, Plaintiff has already dismissed Defendant Crystal Property Management, Inc. from the Third Amended Complaint.

 

 Accordingly, the Court DENIES as moot Defendant Crystal Property Management, Inc.’s Motion for Summary Adjudication.
