OSC re ENTRY OF DEFAULT JUDGMENT

I.           BACKGROUND

On June 2, 2022, Plaintiff Exclusively Contents, Inc. filed its Complaint against Cathy Anthony on causes of action for breach of oral contract, common counts (goods and services rendered), and common counts (open book account).

On November 15, 2022, by request of Plaintiff, the Clerk’s Office entered default on Defendant.

II.        ANALYSIS

Entry of Default Judgment is DENIED. Plaintiff has failed to submit multiple items that are required, including: (1) Form CIV-100, Request for Entry of Court Judgment; (2) Summary of Case; (3) Evidentiary Declaration; (4) Memorandum of Costs; (5) Interest Computations; (6) Declaration of Non-Military Status; (7) Request for Dismissal of Does; (8) Promissory Note or other written obligation to pay; and (9) Proposed Judgment.

The Court will continue the OSC until February __, 2023.  If default judgment is not entered by then, the Court will consider dismissing the case.
