OSC re Entry of Default Judgement and/or OSC re dismissal

        On January 19, 2023, the Court denied Entry of Default Judgement because Plaintiff had failed to file its prove-up package and other documents necessary for Entry of Default Judgement.

        At that hearing, Plaintiff’s counsel indicated that Plaintiff had settled its case with Defendant. 

        The Court continued the OSC re Entry of Default Judgement to today, and indicated that if default judgment was not entered, the Court would dismiss the case.

        Plaintiff has not filed any additional documents, nor has it notified the court that it has dismissed its case and that today’s hearing is off-calendar.

        The Court dismisses the case without prejudice.
