OSC RE ENTRY OF DEFAULT JUDGMENT

 

 

I.           BACKGROUND

 

On June 29, 2022, Plaintiff Chris Langer filed his Complaint against Defendant Moo’s Craft Barbecue, LLC on causes of action pursuant to the Unruh Civil Rights Act and Unfair Competition Law.

 

On September 12, 2022, by request of Plaintiff, the Clerk’s Office entered default on Defendant.

 

On December 12, 2022, the Court denied Plaintiff’s Request for Default Judgment due to Plaintiff failing to submit multiple required items. The Court stated at that time “If default judgment is not entered at that time, the Court will consider dismissing the case.”  (Minute Order, 12/12/22.)

 

 

II.        ANALYSIS

 

Entry of Default Judgement is DENIED. Plaintiff has failed to submit multiple items that are required, including: (1) Form CIV-100, Request for Entry of Court Judgment; (2) Proof of Service; (3) Summary of Case; (4) Evidentiary Declaration; (5) Attorney Fee Declaration (if any); (6) Memorandum of Costs (if any); and (7) Proposed Judgment.

 

In fact, Plaintiff has failed to file any additional documents since the last hearing on December 12, 2022.

 

The Court DISMISSES the case without prejudice.
